Often times an ex will withhold information from the other parent, sometimes just for spite. You’ll meet in a public space and exchange the kids, and off they go, to who-knows-where with your kids for the weekend. And with smaller children it can be difficult to figure out where exactly they were staying. You, as a parent, have a right to know where your kids are staying when they are not with you, and it can often take the court system weeks or months to produce that information. Why wait? We will discreetly arrive at the meet-up location before the exchange and tuck away unnoticed with clear a view. We will document the hand-off and initiate mobile surveillance on the departing parent until they end up at their new destination. Whether it’s drug and alcohol abuse, hours of neglect, or even known criminals or felons visiting the residence, these are all issues we’ve been able to prove for our clients in their custody battles. Who is watching my child?
Sadly, some people don’t seem all that into parenting, and leave their children with a babysitter, friend, or relative for hours on end, even if it violates the terms of their custody agreement. This is an area where surveillance specialists really provide an invaluable service. We’ll document any time the child is dropped off somewhere, identify who they’re staying with, then proceed to follow that parent and show proof for the court what they chose to do with their time instead. Whether they went to work, out to a bar, or worse, we’ll show through indisputable video evidence, exactly how that parent uses the allotted time that is supposed to be spent with their children.
How can I prove they have the ability to pay child support?
Some people, let’s call them deadbeats, often take jobs under-the-table for cash only, or other deceptive means, in order to avoid paying their share of child support. Here is another area where surveillance specialists really generate great results. Sometimes, you already know where they’re working and just need some proof for court. Which makes it easier on us private investigators, for sure, but the key is hiring the right PI who knows what to look for, and has the skills and equipment to document them working for hours, so the proof is indisputable when it goes in front of a judge. We’ve often followed people to cash-prone businesses like bars and clubs, where our high-end, low-light camera equipment made all the difference in blowing open the case. And for day jobs, we follow them to their worksite, get inside when applicable, and show undeniable proof through covert video and hidden cameras that they are holding a job and generating an income, they’re just hiding it and lying about it. Believe me, the courts don’t like that.
Will the evidence hold up in court?
This is perhaps the most important question in child custody cases. Lawyers are a savvy bunch, and the trend I have observed lately is that they like to depose and question the actual investigator that worked the case. What this means is, if the private investigator you met in person or talked to the whole time on the phone, did not work the case themselves, and instead opted to use an intern, a less-experienced employee, or subcontractor for the actual field investigation, the attorney’s will often times bypass the experienced company owner and will instead subpoena and question the less experienced field investigator. Which is smart on their part, but I have seen it wreck other PI’s client’s cases when the inexperienced PI gets beat-up in the deposition and renders the evidence unusable. I have even heard of an investigator confessing to trespassing, when they weren’t (they just didn’t know the law enough to protest otherwise), and folded under pressure because they felt bullied in the deposition. Family law attorney’s are shrewd operators, and they know how to knock-around a weak or inexperienced witness to discredit the evidence that hurts their client. This is why it is imperative you know who is actually working your case! This is also why, in addition to working most cases myself, I only use veteran private investigators, with years of trial and testimony experience, on cases for TMS Investigations. Because evidence is useless if it can’t be defended in court or hold up under scrutiny from the opposing side’s legal team.
